Additional Sessions Judge Ajay Pandey granted the relief to the accused noting there was no eyewitness to the incident except the complainant himself, who denied the prosecution story altogether.
“In view of the fact that the complainant has denied the alleged incident in totality and has further denied the identity of accused persons or identity of case property, the court is of the opinion that accused persons are entitled for acquittal,” the court said.
The complainant had filed a police case in November last year alleging that he was caught by the accused when he was attending to nature’s call on the roadside in the south-west Delhi area.

The man was rescued with the help of fire brigade staff and taken to a hospital in an unconscious state, the police said.
The accused had pleaded not guilty and claimed trial.
