HC directs MLA Harish Poonja to approach lower court for quashing charges

The Karnataka High Court has directed Belthangady MLA Harish Poonja to seek legal remedy from the trial court to quash charges filed against him for protesting and using abusive language against the police.

Justice Krishna S. Dixit, who heard the petitions filed by Harish Poonja, gave the direction on Friday. The MLA had sought the quashing of two FIRs registered against him for allegedly obstructing police duties and using foul language during a protest.

Taking cognizance that a charge sheet had already been filed against Poonja in the trial court, the High Court directed the petitioner to apply to the trial court to quash the charges.

The trial court has been instructed to complete the hearing of this application within eight weeks and to refrain from summoning the petitioner for trial until then.

The Belthangady police had arrested Shashiraj Shetty on charges of illegal mining and storing explosives without a permit. This arrest angered Harish Poonja, who visited the police station, allegedly abused and threatened the officers, and led a protest obstructing their duties.

Consequently, the police registered two FIRs against Poonja. Challenging these FIRs, Poonja approached the High Court.

While the petitions were pending, the police submitted a charge sheet against Poonja and other accused in the trial court.
