The State government in an affidavit maintained that Dwivedi along with other accused, were active members in a gang connected with drug trafficking to make financial gains.

The affidavit stated that there is sufficient digital evidence available against the petitioner to believe that she had committed the crime. It also mentioned the forensic audit of the bank statement of accounts of the petitioner is under process to identify the financial transactions pertaining to drug trafficking.

Dwivedi was arrested on September 4, 2020, following which the state government claimed that she had disclosed names of other accused involved in drug trafficking.

State government shared its concern on her bail, it said that she would alert those accused and help them escape and destroy evidence.

The High Court had rejected bail application by Dwivedi and other accused on November 3, 2020 as the state government alleged that the accused induced her guests to take part in parties.

It asserted that the petitioner would encourage young and rich people to attend parties and consume drugs, procured from Goa, Mumbai, Andhra Pradesh, Punjab and some foreign countries.

A single bench consisting of Justice R F Nariman on January 19, posted the petition by Dwivedi for consideration on January 21.
