Udupi: Insurance can’t be claimed if the driving license isn’t valid

Udupi: The consumer court in Udupi held that no insurance amount is payable if the vehicle met with the accident wasn’t driven by someone with a valid driving license. It further ruled that the insurance company is not liable to disburse personal accident insurance if the person’s driving license wasn’t valid at the time of the accident.

This ruling comes after a person named Chandrashekhar Shetty (48) hailing from Kalthodu village in Byndoor died on the spot, after hitting his car to a roadside tree as a wild boar suddenly crossed his path.

The car was insured with Royal Sundaram Insurance company, the legal heirs of the deceased filed a claim for personal insurance amount of Rs 15 lac.

On the basis that the deceased did not have a valid driving license, the insurance company rejected the claim.

Chandrashekhar’s family later filed a complaint in Udupi District Consumer Disputes Redressal Forum. The consumer court after finding out that the driving license of the deceased has been renewed till January 1, 2016.
Hence the court ruled this argument and passed that the insurance company isn’t liable to pay compensation as the deceased did not have a valid driving license.
