Rao has been booked under the Section 153 (for wantonly giving incitement with aim to cause revolt) of the Indian Penal Code.

The case was enlisted in light of a protest by Dr. Ramachari, the national general secretary of Hindu Task Force. In his complaint, he said that Rao’s comments had harmed the sentiments of the followers of Yogi Adityanath, and that there was a criminal intent to provoke against Hindu notions.

Rao, while talking at a protest staged by the Congress on April 15 in Bengaluru against the rape cases in Unnao (in UP) and Kathua, had called the UP CM a ‘dhongi’ and said ‘he should to be beaten with shoes next time he comes to Karnataka and driven out’.

After a day, he expressed regret on making such statements. “It was an emotional outburst on the predicament of the victims and the total lack of care of the Adityanath government. I regret if it has offended others, yet mishandle of law in UP is a serious issue.”
