High Court denies Nalapad's bail plea

Bengaluru: The Karnataka High Court rejected the bail petition of Mohammed Nalapad Haris.

Based on the grounds that the CCTV footage of the incident clearly shows Nalapad and his friends attacking Vidwath and that there is no guarantee people like him will tamper with the evidence the court has dismissed the bail plea.

The order also states that there are prima facie materials to link Nalapad with non-bail able offences such as Section 306 (voluntarily causing grievous hurt by dangerous weapon) and Section 307 (attempt to murder) of the Indian Penal Code (IPC). In addition, it stated that the incidence was not a case of drunken brawl and the injuries sustained by the victim Vidwath were heinous.

The judge also stated that the session court has strictly given orders to reject bail and that is why the High Court cannot interfere with the decision taken by the session judge.

The judge also stated in his order that the sessions court had given cogent grounds for rejecting bail and thus the high court cannot interfere with the reasons assigned by the session judge’s decision.

Usman P, Nalapad’s counsel has informed the media that they are yet to take decision on the next course of action.
