K'taka HC raps state govt for failing to frame rules under Disaster Management Act

Bengaluru: The Karnataka High Court on Thursday slammed the state government for failing to frame the disaster management plan under the Disaster Management Act 2005.

The division bench, headed by Chief Justice Abhay S Oka said that it will issue directions to the state government to frame the rules while observing that the state government did not find time to frame the rules in the last 12 years after enactment of the Act

The department has not submitted information regarding annual plan of disaster management, the formation of authorities and fixation of fund for the relief work. It shows that the government has failed to take up the relief for flood and drought situation in the state, the bench observed.

Adjourning the hearing to November 27, the court directed the state to submit details on formation of disaster management authorities at the district level and creation of disaster response and mitigation funds, among other things.
